How do I purchase a set a blueprints for a house that the builder is still building?

August 6, 2010 - 1:31 pm 2 Comments

I am having to move from my area to another one about 550 miles away. My wife and I have FINALLY found the perfect home and LOVE the floor plan, elevation, etc. However, the builder in the Austin area does not build this house where we are going, in fact they don’t do any business within 300 miles of there.
My question is, how do we get a copy of the bluerprints? I realize we will have to buy them, and I know the builder probably only purchased the rights to the design from some architect, but how do I go about finding how to get them?
The builder is very coy about it and the local reps all just act like they have no idea where floorplans come from. They say since they are still building it there is NO way anyone can get it, but heck the basic shape is on the darned pamplet they pass out, so I figured there has to be some way to purchase the actual plans.
Thanks

Anytime a builder is beating around the bush pertaining to the work of a consultant raises a red flag. There may be many different reasons why the builder is uncooperative with giving out information, usually, it comes down to some form of disagreement. He has breached the contractual agreement with the architect/residential designer by either non-payment, building the set of drawings beyond the agreement (usually one fee per project), modification to the plans without approval, or simply having a draftsman illegally draw up an existing plan. There is no legal method to force the builder to hand over a set of drawings to you. You may go to the City/County building department and pull up information on the existing permit number. On the cover sheet is usually contact information on the parties involved. Even if the architect/residential designer is not listed, the structural engineer’s name and number should be on it. You can contact the engineer to get you the proper contact information.

LINK INSIDE!! Can you tell me how small this bedroom really is? 8’4×6’6?

August 6, 2010 - 1:31 pm 4 Comments

I will be purchasing a manufactured home in the next couple days but i will be ordering it from the factory so i can’t do a walk through before i order it. The smallest bedroom is 8’4×6’6 and i would like to know if that’s liveable. My wife and i will take the master which is a good size and each of our children will take the smaller bedrooms. Basically two bedrooms are of a good size but the smaller bedroom is alittle small but i just can’t seem to picture it.

It’s tiny. A twin bed and small dresser will fill it up. I hope there is a closet as it will be desperately needed for everything else the child owns.

To give you an idea what you’re looking at, here are some MATTRESS, not bed frame, dimensions:

Twin–39 x 75 inches – 3’3" x 6’3" – this will leave a space about 5′ x 6′ for a dresser and everything else in that child’s world.
(X-Long Twin–39 x 80 inches)

Full–54 x 75 inches – 4’6" x 6’3"

Queen–60 x 80 inches – 5′ x 6’8

King/California King–108 x 102 inches – 9′ x 8’6"

The entire room is smaller than a King size bed and not much bigger than a Queen size. This room will also always be hotter or colder than any other room.

Stuck between 2 houses in Fort Bragg, NC?

August 6, 2010 - 1:15 pm 5 Comments

Ok me and my husband are about to get our first home in Fort Bragg. He’s deployed right now so I have to do all the paperwork & stuff but I’m in TX so everything is via phone, email/internet. We are stuck between 2 houses that I picked out. One is my favorite but the other has a garage so I showed him that one as well. (I know he wants a garage so I want him to have it of course)

The one I favor has a neighborhood center. (Pool, hang outs, room for FRG meetings, stuff for kids to do, place to take dog)
The one I favor has a fenced in patio. (Place to store the grill, have parties/ private tanning, and puppy can be in bathroom emergencies if I’m dealing w/baby & can’t take it outside for a walk)
The one I favor is newer and has nice floor plan.

The one he favors has a garage. (The project car and tools/ grill/ army gear can be stored)
The one he favors has a nice floor plan.
The one he favors has non fenced in patio. (gives more yard room than fenced in would)

There are obviously more pros about the first house than the second, but its a big deal that the second has a garage. If the first house had a garage or at least a car port- there would be no comparison. I have never lived in NC before. Only stayed for 2 weeks so I dont know much about anything. The first house is actually on base and the second is on Pope air force base. I really dont know how far that is from where he works though. Is there anything I’m not taking into account? Keep in mind that I really love the first house, but like the garage for hubby and his Eclipse. We have 3 vehicles total. Help?

Living on Pope and driving to Ft. Bragg will be a real thrash because of the traffic and check points. Not worth all the extra time. It is only about 10 miles away from Bragg. You will also have to learn to live with the constant roar of jets overhead and on the ground. Bragg has lots of big pine trees for shade they have been replacing windows, floor coverings etc. All homes are painted the same and you cannot change colors. The rules are strict. Grandson and wife lived there for years. The humidity there will do you in at first. Not to mention the heat and deluge of rain storms. The average rain fall there is about 48". You will be living in what they refer to as the sand hills. It is very flat and only about 25′ above sea level. Enjoy your new spot. You will need aromatic cedar chips for closets because of moths. Leather has a tendency to mildew.
EDIT–There are all sizes of really nice storage units prior to entering Pope, on the same road and very cheap. Perhaps you could content him with one of these.

what is this movie in 1978?

Tensions are running high in the United States. The recently deceased are returning to life as shambling, flesh-eating ghouls, and political dissidents are threatening social stability. In the city of Philadelphia, Fran (Gaylen Ross) an employee of WGON-TV and Radio learns that her program director Givens is broadcasting out-of-date information about rescue stations that have been overrun by the living dead. Fran’s boyfriend Stephen (David Emge), who pilots the station’s traffic helicopter, arrives at the station and tells her that they must escape in order to survive. He plans on stealing the station’s helicopter and demands that Fran meet him on the roof at 9pm.

Meanwhile, in another part of Philadelphia, the city’s SWAT team is preparing to launch an assault on a low-income tenement building filled with refugees who refuse to leave their homes for emergency shelters; they also refuse to give up their dead, harboring them in the basement of the tenement. After gun battle with armed bandits on the roof, the police and National Guard soldiers break into the building using tear gas. Roger (Scott H. Reineger) one of the SWAT troopers, becomes disgusted by the bloodthirsty behavior of some of their fellow SWAT members when one of them goes crazy and begins shooting at both zombies and innocent bystanders. A tall figure in a gas mask shoots the rogue officer dead. Roger retreats to the basement to escape the confusion, but the tall figure follows him. He removes his mask and reveals himself to be an imposing man named Peter (Ken Foree). They have some small talk and agree that the zombie plague will only get worse. Roger tells Peter about his friend who has a helicopter; he plans to leave with Stephen and Fran, and suggests Peter join their escape. A priest emerges from a room in the cellar; the man is missing a leg and walks with a crutch. He tells them that he has administered the last rites to the dead people in the next room, and that the soldiers may now "do what they will" with them. Peter and Roger kill all the zombies in the cellar, the gravity of the situation nearly overcoming them.

Meanwhile, Stephen and Fran arrive in their helicopter at an abandoned police station pier on the Delaware River to refuel and wait for Roger to show up. They are surpised when four rogue policemen arrive and threaten them for looting the place. Roger and Peter arrive and the rogue cops back down allowing the four to go on their way. Stephen and Fran are surprised that Roger has brought someone with him, but they agree to take Peter with them. The four of them fly all night.

In the morning, Stephen lands the helicopter at a small, deserted rural airport depot to refuel. While exploring the area, zombies attack them from out of nowhere. Stephen tries to prove his manliness before Fran — who is carrying his child — but he is both clumsy and a poor shot. Roger has to kill the zombies Stephen weakly shoots at, and Stephen nearly kills Peter when aiming for a zombie.

Later, while in the air again, they see a deserted shopping mall. They land on its roof and break in through a skylight to rest and to collect supplies. The place is full of zombies milling about inside, drawn to a place that had meant so much to them when they were alive. Despite the growing number of undead outside, the four refugees realize that they could successfully live there for a long time. It even has a gun shop so they will be able to find weapons to defend themselves. Using the mall’s floorplans and master keys, Peter, Roger and Stephen race around the mall, collecting the supplies they will need to make a home. They take these supplies to an upstairs area where they and Fran build a home in an annex of former offices and storage rooms. Fran is resistant to the idea; she thinks it is a bad idea to leave what is left of society, but perhaps because she is pregnant and wants to do what’s right for her child, she stays.

They realize they need to rid the mall of zombies. A decision is made to block the entrances to the mall with semi-trucks from a nearby warehouse. While Stephen watches from his circling helicopter, Peter and Roger hotwire the trucks and drive them to the mall. Peter is disturbed that Roger seems to be losing his grip on reality; he becomes arrogant and takes unnecessary risks in order to demonstrate his mastery of the situation. Unfortunately, he is bitten by zombies while trying to get into one of the trucks. They all realize that Roger’s wound will prove fatal, as nobody can survive a bite for more than a few days. Fran is conflicted; she wants to take Roger to a medical facility, but the others won’t hear of it. They are convinced Roger is doomed.

Over the next several days, they begin to make the mall their home. They care for the ailing Roger as best they can, but his condition rapidly deteriorates until it is clear he is on the verge of death. Peter builds a fake wall in front of the only stairwell that leads to t

new construction loan?

August 6, 2010 - 1:14 pm 3 Comments

ok i am looking to build a home in a community where there are like 7 floorplans and you pick that and the options and they build. How would the loan be on this? Would it be considered a new home or would it be considered a construction loan? Also when building a home like this when would the pymts start? If they started building say in January when would they start?
Sorry so many litte questions I am just trying to figure this out?
the builder is going to be under is K&B homes
If that helps any

I know there is construction loans that cover up to 4 months of mortgage payments but your best bet is to contact a loan officer in your area. The have several plans and even your homebuilder could give you a contact.

Coventry Homes vs. Meritage Homes?

August 6, 2010 - 1:07 pm 2 Comments

Please give me your opinion on each builder, because I am looking to build my first home. I had no idea building a home was so complicated. I want opinions on the craftsmanship, quality, appearance, etc.

There is no model to view for the floorplans I want to build. Both builders have models to view, but they are not comparable to the floor plan I am interested in. Therefore, I really cannot visualize what I would be getting.

Please help. Thank you!

Meritage is listed as #2 on the Imploded Builder’s "Ailing" list. Might be wise to avoid them: http://builder-implode.com/

Ailing Builders haven’t shut down, but they’ve suffered significant valuation declines, temporarily halted redemptions, or faced other major business hurdles. Builders on watch may not even have unusual declines relative to peers, but may be posted if it is felt there may be risk of developing a more serious condition in the near future.

I signed a real estate contract, but was not told the truth….what are my options?

August 6, 2010 - 1:07 pm 2 Comments

I recently (last week) put $500 down on a lot where I am going to build a home. I put the money down on a lot that a builder owned, the same builder that will be building my home, have not got into floorplans or anything, just knew I wanted the pond lot. As i walked in to sign the legal stuff and put my $500 down, the FIRST question i asked to the sales rep was "I know that this is a dumb question, but this lot is not in a flood zone is it?" she said "oh no its not, we wouldnt be able to sell the lots if they were." I said ok, signed and gave my check……a week later i find out from the mortgage lady (not the sales rep) that the land is in fact in a flood zone. How is this situation going to work out?? Will I get my money back and out of the contract (since I wouldnt have signed it had I known). I researched the city flood zones and it is NOT in a flood zone, but according to FEMA it is………

Thanks for any and all advice…….

What does your contract say?

Does your contract give you a contingency period where you have the right to inspect the property and determine if the property will work for you?

If yes, the remedy is usually (but not always) that you have the right to cancel the contract and have your money returned.

However it must say that in the contract.

Also, I recommend that you interview several attorneys who practice Real estate Law.

(this is a good exercise to go through even if you do not need an attorney right now)

One day you probably will need an attorney and it is a good idea to get to know a few attorneys and learn what an attorney can do for you as well as what an attorney cannot do for you.

The best way to learn is by interviewing attorneys.

You will also get some good ideas for what to say to the builder if he is not cooperative.

Let several attorneys inspect the sales contract and let them tell you what is wrong with your sales contract. I guarantee you that a good attorney will point out many things that are wrong with the contract that you signed.

You will find this to be very educational for the future even if the builder is agreeable and lets you out of your contract and returns your money without an argument.
