Can I back out of my contract if the builder files for Chapter 11 and get back my earnest money?

Orleans Homebuilders files for bankruptcy!!!This story was in the Chicago Tribune Monday 03/01/2010."Orleans Homebuilders, Inc., a Pa.-based homebuilder with developments in five Illinois communities, filed for Chapter 11 bankruptcy protection in U.S. Bankruptcy Court in Wilmington, Delaware.

The company said it bankruptcy filing was needed because a $350 million senior secured revolving credit loan agreement had matured and it was unable to reach an agreement to extend the credit facility with 100 percent of its 17-member bank group or obtain a replacement facility.

Orleans said it had reached, pending court approval, an agreement for $40 million in debtor-in-possession financing and there would be no interruption in the operation of its 11 divisions in eight states. Orleans has suburban Chicago developments in Lake Villa, Aurora, Schaumburg, Bolingbrook and Woodridge.

The filing does not include its mortgage services subsidiary, Alambry Funding, Inc., which provides mortgage brokerage services for customers". We wrote a check to Alambry Funding Inc. They have not broke ground yet.We gave them a check at the begining of Jan. 2010 and were the 3rd buyers out of 11 that signed a contract with this builder.Anybody with experience in this let me know what I should do.

It’s worth a phone call to Alambry. There may be hope to get your deposit back especially in view that the construction will not likely proceed.

My husband has a co-worker that works in these new homes as an electrician on his time off. Since we have a property he’s trying to convince my husband that buying land, between 20-40 k to make these new homes could be sold for about 150-200 k
We would have to ask the bank extra money to build the house also since our property is worth 90k How much do you guys think a new house would cost just to build it? I dont have an idea. My husband is contemplating the idea but I want to do more research on this. Any homebuilders out there?

OK so I work at a golf course and we have a big tournament coming up and me and another girl like to make shirts with sayings on them they are always kinda sexual or funny cause its a bunch or old rich men and it makes our tips better and I cant come up with one this year its for the Homebuilders Assc. Last year out shirt said " lets get hammered and screwed" so does anyone have any ideas????? Thanks

Building Permits and Fees?

Is it me or is this crazy county I live in overcharging for building permits. I have been living in Eldorado County (Northern California) for the past ten years. With the housing boom, I have seen this area grow dramastically. With all this development and money flowing through this area some ones pocket is disgustinly getting bigger. Just in building permits and fees you are expected to pay over $50,000. What in the heck is wrong with this picture. If its not the price of land, we now have to deal with the price of building permitts. It is sickening for the small scale homebuilders in the area who have no way of competing with outrages land prices and now building permits??

In California, it is NOT legal to charge more for building permits than it cost the city/county to administer the programs. So if building permits charges are excessive, your only option is to sue the city/county.

This is exactly what happened in Orange County. A builder sued the county over the cost of building permits and WON sort of. The county had to lower the building permit cost for future permits but did not have to refund the previous overcharges.

Why don’t we have any politicians in the U.S.A. who believe in the market system?

Now the congress is putting together a housing market stimulation package as a result of the lobbying by the homebuilders.
Why can’t they just let the marketplace figure things out?
Isn’t that the best way to do things rather than have politicians mess everything up for us?

How do land developers/builders profit through the use/exploitation of Community Development Districts (CDDs)?

More specifically: Community Development Districts(CDD) are For-Profit entities compared to Home Owner Associations (HOA) which are Non-Profit entities, what are the ways in which land developers and homebuilders profit through the use and or exploitation of CDDs?

Community development districts (CDDs) are independent special-purpose units of government established to finance basic services within a development, including infrastructure construction, services and maintenance. Common infrastructure improvements provided by CDDs include drainage, potable water, sewerage, roads and parks. CDDs also have the power to collect fees, levy lienable assessments or ad valorem taxes against properties within the project for repayment. Community Development Districts are getting more and more popular among politicians, developers and the whole connected industry. Local politicians love them, figuring they get all the future property taxes without having to invest anything. Developers can create their own little kingdoms without being supervised. They can write their own ticket and make huge profits without any big risks to them. The public bonds will finance all the necessary investments and if financial losses can’t be avoided the homes of the people are the collateral for possible losses. Miscalculation from developers can be covered with money from the homeowners.
As in most cases the idea behind creating Community Development Districts is really good. But lack of supervision from the government agencies, which initially created these communities within communities, and the lack of enforcement of the existing Statutes, has definitely made many people think twice about the advantages of these developments.

Do I have grounds to ask for a price change?

If I am in the process of having a house built(which will close end of this month), and the homebuilders slash the prices of their homes for whatever reason by a significant amount (say $10k), am I allowed the same price or am I stuck with what I have? I haven’t signed anything other than a good-faith estimate and a contract to build. Can I argue this point to anyone and if so who do I go to first??????

Go to your real estate agent. If you have proof that others are getting a lower price, you may be able to get them to lower the price for you as well.
