As an appraiser I can tell you that anything below grade (even if only 1 wall is below grade) CANNOT be counted in room count or living area. The Fannie Mae Guidelines for using the GLA (and room count!) say that only those part of the house that are "100% above ground" should be include in the GLA (and room counts!). If you're trying to obtain a Fannie Mae or Freddie Mac loan the appraisal has to be compliant with their guidelines.

Rooms below grade are typically given credit as "finished basement rooms" on the appraisal grid under the "basement" section.

There are exceptions to this rule, however. Berm houses, which typically don't have any area completely above grade, are considered homes on slabs in which ALL rooms and all square footage are counted.

If the property you are interested in qualifies as an earth berm house then another appraisal should be ordered. If your property is more of raised building with a walkout daylight basement - well, the underwriter was correct in saying that it is a two bedroom home and it should be compared to at least one other two bedroom home.

Appraisers are becoming more and more restricted in exceptions and adjustments which can be made.
References :
Certified Residential Appraiser

There are two things you need to look at. In addition to a window and a door a room must have a closet to be a bedroom.

But, also, you need to look at building permits. If they added those rooms without permits and building inspections you can't add them. Legally they do not exist. This is also a property tax problem, as you can't have them without paying property taxes for them, and you do not do that until after the inspection.

Call the building department, ask them how many bedrooms that place has, their answer is the legal answer that the bank has to go by. It very well may be a 2 bedroom house.
References :
No an unsecured loan means just that. There is no collateral attached to the loan. Your house is safe. However, your credit will be destroyed if you allow the loan to fall into bad debt. If you can't pay the loan, call the creditor and they may allow you to make interest payments only. At any rate, deal with the creditor in good faith. Just don't sit there and not pay the loan. If they gave you the loan unsecured that means the creditor determined that you have the means and history to pay this loan. So, get on the phone and off the internet and deal with the creditor in good faith.
References :
The underwriter is clueless relative to what comprises a bedroom and what does not. As long as these rooms are finished in a quality similar to the upper level of the house, have egress windows and closets, they are qualified bedrooms. Sadly for you, underwriters are not always the sharpest knives in the cutlery rack, and you got one of those dull knives.

That being said, an appraisal on a home such as you are purchasing may NOT be comparable to homes where all three or four bedrooms are on the upper level(s). Since two of those rooms are 'basement', they may command less value per square foot than those on upper levels.

As far as any Indiana law goes, there are no such laws. You simply have to deal with the decision of your underwriter.
References :
Usually on an unsecured loan the lender can only obtain a legal judgement and place a lien on your assets, not force you to sell your residence. If a judgement is secured the lien would have to be paid with interest if your house is sold. They can go after your other assets such as bank account, garnish your wages etc.
References :
If you are already approved go with a different lender. You can apply for as many in 30 days without lowering your credit score. Reference the hud.gov website for home buying and start making calls from that website to answer your question.
